These Terms and Conditions explain the terms that apply when you use this website, request information, download materials, submit a form, schedule a call, or purchase services or products from Kim West Design LLC.

Kim West Design LLC is the company operating this website. Any reference to "Kim West Design" on this website, in communications, or in marketing materials refers to Kim West Design LLC.

By using this website, submitting information through this website, scheduling a meeting, downloading materials, or purchasing services or products, you agree to these Terms and Conditions.

About Kim West Design LLC

Kim West Design LLC provides design related services for remodel professionals and homeowners, including the Mini Virtual Consultation, the Full Virtual Consultation, Client Design Session, Trade Design Day, the Design Day with Kim, Concept Rendering + Moodboard, and Custom Quote projects. Custom Quote projects may include renderings, moodboards, product specification, product procurement, delivery and installation of furnishings and non-structural finishes, buying guide documentation, or other design deliverables as scoped in the individual project agreement. Kim West Design LLC also refers clients to products through third party links and sells select physical products directly. Kim West Design LLC may introduce additional services over time, which will be described on the website or provided directly to the client at the time of purchase.

Kim West holds a degree in interior design and has specialized training as a kitchen and bath designer, but is not a general contractor, architect, engineer, structural designer, a Nevada Registered Interior Designer, residential designer, safety professional, permit professional, or construction manager.

Website Information

The information on this website is provided for general informational and marketing purposes. Website content may describe available services, service limits, current offers, design process, project examples, and general service expectations.

Kim West Design LLC may update, revise, remove, or change website content, service descriptions, pricing, offers, availability, and terms at any time.

Service Availability

Services are offered based on availability, project fit, location, scope, and scheduling capacity.

Kim West Design LLC may decline a project, request additional information, require a custom quote, or recommend a different service if the requested work does not fit within the standard service menu.

Prepaid Services

All services are prepaid unless otherwise agreed in writing. Time is not reserved and work does not begin until payment is received and the specific service requirements are met.

New Partner Offer

Kim West Design LLC may offer, by invitation, a complimentary Mini Virtual Consultation and a discount on a first paid service to new partners. Each offer is provided as a personal code, is single use, cannot be transferred, combined with other offers, or applied to custom quotes, and is valid only until the expiration date stated with the code. Kim West Design LLC may modify or end this offer at any time.

Custom Quote Projects

Custom Quote projects are billed according to the rate, retainer, and payment schedule stated in the individual project agreement. A retainer is generally collected before work begins, and hours are billed against it as work is completed, on the schedule set out in that agreement. Any remaining balance is due as specified in the project agreement.

For Custom Quote projects, intake information is most often collected directly by Kim West Design LLC through conversation, site visits, and/or consultation with the client and other remodel professionals, rather than through a written or digital intake form. An intake form may still be used at any time, at Kim West Design LLC's discretion.

Intake Information

Custom Quote Projects require complete project information before work can begin, whether collected directly by Kim West Design LLC through conversation and/or site visits, or through an intake form, as described under Custom Quote Projects above. This may include photos, style, or inspiration images, project notes, site measurements, consultation with other remodel professionals, and vendor information where applicable, as specified in the project agreement. The Full Virtual Consultation includes an optional intake form, recommended so the session can be prepared for; the session proceeds as scheduled, either way. The Client Design Session, Trade Design Day, and Design Day with Kim include an intake form that must be completed prior to the scheduled session. The Concept Rendering + Moodboard requires a completed intake form before work begins.

If a required intake form is not completed at least 4 hours prior to the session, Kim West Design LLC will reach out to confirm the essentials, including the meeting location. If the location and contact details cannot be confirmed before the session, it will be rescheduled once at no charge. A second missed confirmation is treated as a late cancellation.

Incomplete, unclear, conflicting, or changing information may delay the work or require a revised custom quote.

Kim West Design LLC is not responsible for delays, errors, revisions, or incomplete results caused by inaccurate, missing, outdated, or incomplete project information provided by the contractor, client, vendor, installer, or other third party.

Meetings

The Mini Virtual Consultation, Full Virtual Consultation, Client Design Session, Trade Design Day, and Design Day with Kim are scheduled into available meeting windows and end at the scheduled time. Same day extensions are not guaranteed and are offered only as described under Same Day Add On Hour below.

The Design Day with Kim is spent entirely with the homeowner. Support for a contractor or the contractor's team, without the homeowner, is booked as a Trade Design Day.

Travel Time

For in-person services, travel time to the first location is included. All other travel during a session, such as travel between project sites, showrooms, or suppliers, is counted as part of the session time.

For the Trade Design Day, the last 15 minutes are reserved for the status note and delivery of any digital files. Samples or materials collected during the day can be handed off at the final location with minimal added time, or delivered to the contractor, with any type of delivery counted as part of the four hours. Return travel to Kim West Design LLC's office is not counted. The plan for the end of the day is confirmed on the opening call.

For the Client Design Session, In-Person Design Consultation, and the Design Day with Kim, travel within 25 miles of Kim West Design LLCs's studio in the 89148 zip code is included. Locations beyond 25 miles are subject to a travel fee, stated at booking and billed before the session.

Trade Design Day

The Trade Design Day is a block of time, not a fixed set of deliverables. It begins with a short phone or video call to review the contractor's input, files, and instructions and to put the requested tasks in priority order. Kim West Design LLC works through the tasks in that order and sends a short status note at the end of the session. The opening call, travel during the session, the 15 minute wrap up and any sample delivery as described under Travel Time, all agreed tasks, and delivery of materials, selections, and drawings are part of the four hours. The contractor must designate a contact who is available for questions during the session. Drawings require focused office time, so days that include site visits or travel allow only small drawing items. Each Trade Design Day ends at the four hour mark. Tasks not completed within the session may continue in another Trade Design Day, a Same Day Add On Hour, or be quoted as Customized Design Support. Unfinished drawings or selections will be delivered as is, marked in progress, unless arrangement for the work to be paused until next session has been agreed to at the start of the Trade Design Day. Time is used within a single day and does not carry over.

Same Day Add On Hour

One additional hour may be added to a Trade Design Day, Client Design Session, or Design Day with Kim already in progress, only if both parties agree and Kim West Design LLC's schedule allows that day. A maximum of one hour may be added per session. The add on hour rate is stated at the time it is offered and must be paid in full before it begins. The add on hour follows the same terms as the original session and ends at the close of the added hour. Unused time does not carry over and is not refundable.

Production Schedule

Custom Quote project work, including any rendering, moodboard, space plans, elevations, product specification, or buying guide work included as part of a custom quote, is placed into the production schedule after payment is received and complete project intake information is collected.

Timing for Custom Quote projects is estimated in the individual project agreement and may vary based on current workload, task complexity, completeness of information, and project scope. Any stated timeframe is an estimate unless Kim West Design LLC confirms a specific deadline in writing.

The Concept Rendering + Moodboard is typically delivered by email as PDFs within one business day of receiving complete intake information. This timeframe is an estimate, not a guaranteed deadline.

Revisions

Revision terms vary by service.

Revision terms for any design deliverable provided as part of a Custom Quote project, including renderings, moodboards, space plans, elevations, product specification, or buying guide documentation, are set in that project's agreement. Unless the agreement states an included revision allowance, revisions are billed at Kim West Design LLC's current hourly rate.

Revisions beyond any amount included in the project agreement, expanded design directions, layout changes, new information, or client requested changes are billed at Kim West Design LLC's current hourly rate or require a separate service purchase.

Concept Rendering + Moodboard

The Concept Rendering + Moodboard is purchased per space and includes one conceptual rendering, one coordinating moodboard, and one revision of the same space, requested within 10 weeks of delivery. It does not include space planning, product sourcing, or a buying guide. A new design direction or a different space requires a new purchase. These visuals are aesthetic and conceptual only, are not dimensionally accurate, and do not represent sourced products. All sales are final once the intake form is submitted.

Affiliate and Referral Links

Kim West Design LLC may share links to products, materials, or retailers as part of a design recommendation. Some links may be part of an affiliate or referral program through which Kim West Design LLC may earn a commission at no additional cost to the client.

Kim West Design LLC does not process, ship, or fulfill purchases made through these links. A purchase made through a third party link is a transaction directly between the client and that retailer, and is subject to that retailer's own pricing, availability, shipping, return, and warranty policies. Kim West Design LLC is not responsible for product quality, defects, delays, damages, or losses related to a third party retailer's products or service.

Direct Product Sales

Kim West Design LLC also sells select physical products directly, purchased wholesale and shipped or delivered to the client. Pricing is provided at the time of sale and is subject to change until the order is confirmed and paid.

Direct product purchases are prepaid in full before an order is placed with the manufacturer or supplier. Once an order has been placed, it cannot be canceled and is not eligible for a refund, since Kim West Design LLC has already committed payment on the client's behalf.

Lead times, shipping timeframes, and product availability are set by the manufacturer or supplier, not Kim West Design LLC, and are estimates only.

Risk of loss and title for a product transfer to the client once the product ships. Kim West Design LLC is not responsible for shipping delays, carrier damage, lost shipments, or delivery issues once a product has shipped, though Kim West Design LLC will assist the client in filing a claim with the manufacturer, supplier, or carrier where reasonably possible.

Products are covered only by the manufacturer's own warranty, if any. Kim West Design LLC does not provide an independent warranty on any product sold or referred.

Damaged, defective, or incorrect items must be reported to Kim West Design LLC within 3 business days of delivery so a claim can be filed with the manufacturer, supplier, or carrier. Kim West Design LLC does not guarantee replacement, repair, or refund outcomes controlled by a third party manufacturer or supplier.

Custom, special order, and made to order products are final sale and cannot be returned or exchanged once ordered.

Services Kim West Design LLC Does Not Provide

Kim West Design LLC does not provide the following services:

·         Construction estimating

·         Project management

·         Plumbing detail drawings

·         Technical detailing

·         Code compliance

·         Construction installation management

·         Construction installation services

·    Construction delivery management

·         HVAC information

·         Licensed contractor services

·         Architectural services

·         Structural engineering services

Where Kim West Design LLC coordinates delivery and/or installation as part of a Custom Quote project, that work is limited to non-structural, decorative placement of furnishings, finishes, and accessories, not construction related installation.

Product sourcing and procurement for a specific project may be provided through a Custom Quote engagement, governed by the Direct Product Sales terms above. If Kim West Design LLC introduces a new service in the future, such as on site design oversight of an installation, the terms for that service will be described separately and may differ from this list.

Kim West Design LLC’s work is intended for design direction, visual communication, selections, and discussion purposes within the stated service scope.

Contractor Responsibility

Contractors are responsible for verifying project conditions, dimensions, construction feasibility, code compliance, permitting requirements, product suitability, structural requirements, installation requirements, ordering accuracy, and final construction decisions.

Contractors are also responsible for communicating with their clients, vendors, installers, subcontractors, and other project professionals unless otherwise agreed in writing.

Client Responsibility

If a contractor involves their client in a meeting, review, or design discussion, including a Client Design Session, the contractor remains responsible for the contractor client relationship, project pricing, construction commitments, contractual terms, jobsite conditions, and final project decisions.

Kim West Design LLC does not replace the contractor’s responsibility to manage the remodel, construction process, final product specifications, schedule, subcontractors, vendors, permits, or installation.

Design Accuracy and Limitations

Conceptual services and design intent drawings are intended for visual direction and discussion. They are not construction documents, permit drawings, engineering drawings, shop drawings, fabrication documents, installation instructions, or final order documents.

All measurements, field conditions, product specifications, appliance specifications, cabinet details, and installation requirements must be verified by the contractor, vendor, installer, or appropriate licensed professional before ordering or construction.

Payments and Refunds

Custom Quote projects, including any rendering, moodboard, space plan, elevation, product specification, or buying guide documentation work included as part of a custom quote: payment terms are set in the individual project agreement. Unless otherwise stated in writing, a deposit, retainer or prepayment is due before work begins and is non-refundable once work has started. Any remaining balance is due as specified in the project agreement. If there is an outstanding balance, work by Kim West Design LLC will pause immediately. These Terms and the existing project agreement remain in effect for all work already completed and any amounts already paid. Work will resume once amounts due are paid in full, or as otherwise agreed in writing.

The Concept Rendering + Moodboard and the Same Day Add On Hour follow the refund terms stated in their own sections above.

Direct product purchases follow the payment and refund terms stated under Direct Product Sales above.

Cancellations and Rescheduling

To qualify for a refund, cancel or reschedule at least:

The Mini Virtual Consultation: 24 hours before the scheduled start

Full Virtual Consultation: 36 hours before the scheduled start

Client Design Session: 48 hours before the scheduled start

Design Day with Kim: 48 hours before the scheduled start

Trade Design Day: 48 hours before the scheduled start

A no show is official if the client is not present within 15 minutes of the scheduled start time, and no shows are not eligible for a refund.

Termination

Kim West Design LLC may terminate a Custom Quote project, or end any other engagement, at any time and for any reason, including missed or late payment, unsafe or abusive conduct toward Kim West Design LLC or its staff, or a determination that continuing the project is not workable.

Upon termination, the client remains responsible for payment of all hours worked and fees earned through the termination date. Any retainer or deposit already applied to completed work is non-refundable. Kim West Design LLC will deliver any completed work product the client has paid for, but is not obligated to complete work left unfinished at termination.

Chargebacks and Payment Disputes

Please contact Kim West Design LLC directly with any payment concern before initiating a chargeback or payment dispute.

A chargeback does not automatically cancel the amount owed for completed services, delivered products, reserved time, delivered files, or custom work performed under the terms above. If a chargeback or payment dispute occurs, Kim West Design LLC may pause current work, withhold future work or products, cancel pending meetings, or require an alternate payment method before continuing.

If a chargeback is found to be improper or inconsistent with these Terms, the client or contractor remains responsible for the unpaid balance, processor fees, chargeback fees, administrative costs, and reasonable recovery costs to the extent allowed by law.

Nothing in these Terms limits any legally protected right to dispute a true billing error or unauthorized transaction.

Intellectual Property

Website text, service menus, design materials, concepts, renderings, moodboards, buying guides, product schedules, files, images, and other materials created by Kim West Design LLC are owned by Kim West Design LLC unless otherwise agreed in writing.

After full payment, the contractor may use delivered project materials for internal project review, client discussion, pricing, and project planning for the specific project for which the materials were created.

Materials may not be copied, resold, reused for unrelated projects, altered, used as templates, publicly posted, or distributed outside the project team without written permission from Kim West Design LLC.

Portfolio Use

Kim West Design LLC may request permission to use selected project images, renderings, moodboards, drawings, or completed project photos for portfolio, marketing, website, or social media purposes.

Kim West Design LLC will not knowingly publish confidential client information, private addresses, or sensitive project details without permission.

Third Party Tools and Links

This website may link to third party tools, scheduling platforms, payment processors, file downloads, cloud storage, social media platforms, or other external services.

Kim West Design LLC is not responsible for the content, security, privacy practices, availability, or policies of third party websites or platforms.

SMS Messaging Program

By opting in through the website's consent form, you agree to receive text messages from Kim West Design LLC. You will receive notifications of meetings, alerts of any changes to your appointments, updates on your ordered services, and other customer service related messages. No marketing or promotional messages are sent under this SMS service. The frequency of messages may vary. Message and data rates apply. Check with your carrier for details. To stop receiving messages, reply STOP to any text message, or reply HELP for assistance. Carriers are not liable for delayed or undelivered messages. You must be 18 years or older to use this SMS service.

No Guarantee of Results

Kim West Design LLC aims to provide professional design support, visual direction, and useful project information. However, Kim West Design LLC does not guarantee contractor sales, client approval, project profitability, construction outcomes, product availability, pricing accuracy, vendor performance, installation results, or permitting outcomes.

Limitation of Liability

To the fullest extent allowed by law, Kim West Design LLC is not liable for indirect, incidental, consequential, special, punitive, or business losses arising from use of this website, reliance on website information, downloaded materials, design services, product purchases, project delays, construction decisions, product issues, installation issues, or third party actions.

Kim West Design LLC's total liability for any claim related to a purchased service or product is limited to the amount paid to Kim West Design LLC for that specific service or product.

Indemnification

You agree to hold Kim West Design LLC harmless from claims, damages, losses, liabilities, costs, or expenses arising from inaccurate information you provide, misuse of design materials, construction decisions, installation decisions, improper installation or misuse of a purchased product, third party errors, unauthorized use of materials, or violation of these Terms and Conditions.

Changes to These Terms

Kim West Design LLC may update these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date.

Your continued use of this website after changes are posted means you accept the updated terms.
