These Terms and Conditions explain the terms that apply when you use this website, request information, download materials, submit a form, schedule a call, or purchase services from Kim West Design.
By using this website, submitting information through this website, requesting the Contractor Design Menu, scheduling a meeting, downloading materials, or purchasing services, you agree to these Terms and Conditions.
About Kim West Design
Kim West Design provides design related services for remodel contractors, including Virtual Meetings, In Person Meetings, Behind the Scenes Design, Concept Moodboards, Conceptual Phase Renderings, Detailed Cabinetry Design plus Renderings, and Project Design Package services.
Kim West Design is not a general contractor, architect, engineer, structural designer, permit professional, procurement company, installation manager, or construction manager.
Website Information
The information on this website is provided for general informational and marketing purposes. Website content may describe available services, service limits, current offers, design process, project examples, and general service expectations.
Kim West Design may update, revise, remove, or change website content, service descriptions, pricing, offers, availability, and terms at any time.
Contractor Design Menu
If you request the Contractor Design Menu, Kim West Design may provide access to current service descriptions, launch pricing, trial offers, package limits, prepaid terms, and related service information.
The Contractor Design Menu is provided for informational purposes and does not create a service agreement by itself. Services are not reserved and work does not begin until payment is received and required project information has been provided.
Service Availability
Services are offered based on availability, project fit, location, scope, and scheduling capacity.
Kim West Design may decline a project, request additional information, require a custom quote, or recommend a different service if the requested work does not fit within the standard service menu.
In Person Meetings are currently limited to the Las Vegas Metropolitan Area unless otherwise agreed in writing.
Prepaid Services
All services are prepaid unless otherwise agreed in writing.
Time is not reserved and work does not begin until payment is received. For time based services, prepaid time may be tracked in 15 minute increments when applicable.
If additional time, scope, revisions, meetings, sourcing, design work, or project communication are needed, additional prepaid time or a separate prepaid service may be required before work continues.
Intake Information
Many Kim West Design services require complete project intake information before work can begin. This may include measurements, photos, floor plans, appliance information, sink information, cabinet line information, finish direction, inspiration images, style direction, project constraints, or other details needed for the requested service.
Incomplete, unclear, conflicting, or changing information may delay the work, change the project scope, require additional prepaid design time, or require a custom quote.
Kim West Design is not responsible for delays, errors, revisions, or incomplete results caused by inaccurate, missing, outdated, or incomplete project information provided by the contractor, client, vendor, installer, or other third party.
Meetings
Virtual Meetings and In Person Meetings are scheduled into available meeting windows.
Meetings end at the scheduled time. Same day extensions are not guaranteed and must be approved and prepaid before the meeting begins.
In Person Meetings include the meeting scope stated in the current Contractor Design Menu or applicable service description. Unless otherwise agreed in writing, In Person Meetings are limited to one residence per occurrence.
Production Schedule
Behind the Scenes Design, Concept Moodboards, Conceptual Phase Renderings, Detailed Cabinetry Design plus Renderings, and Project Design Package work are placed into the production schedule after payment and complete project intake information are received.
Estimated timing may vary based on current workload, task complexity, completeness of information, project size, and requested service type. Any stated timeframe is an estimate unless Kim West Design confirms a specific deadline in writing.
Revisions
Revision terms vary by service.
Some services may include no revisions. Some services may include one limited revision round. Additional revisions, expanded design directions, major layout changes, new information, or client requested changes may require additional prepaid design time or a separate service purchase.

Kim West Design does not provide the following services:

· Electrical detail drawings
· Section drawings
· Permit drawings
· Structural drawings
· Construction estimating
· Project management
· Plumbing detail drawings
· Product ordering
· Procurement
· Technical detailing
· Code compliance
· Final order review
· Installation management
· Installation services
· Delivery management
· HVAC information
· Licensed contractor services
· Architectural services
· Structural engineering services
Kim West Design’s work is intended for design direction, visual communication, selections, cabinetry concepts, contractor support, and discussion purposes within the stated service scope.
Contractor Responsibility
Contractors are responsible for verifying project conditions, dimensions, construction feasibility, code compliance, permitting requirements, product suitability, structural requirements, installation requirements, ordering accuracy, and final construction decisions.
Contractors are also responsible for communicating with their clients, vendors, installers, subcontractors, and other project professionals unless otherwise agreed in writing.
Client Responsibility
If a contractor involves their client in a meeting, review, or design discussion, the contractor remains responsible for the contractor client relationship, project pricing, construction commitments, contractual terms, jobsite conditions, and final project decisions.
Kim West Design does not replace the contractor’s responsibility to manage the remodel, construction process, schedule, subcontractors, vendors, permits, or installation.
Design Accuracy and Limitations
Conceptual services are intended for visual direction and discussion. They are not construction documents, permit drawings, engineering drawings, shop drawings, installation instructions, or final order documents.
Detailed Cabinetry Design plus Renderings may include cabinet drawings, renderings, 2020 Design Live items, cabinet parts list, quote, and kit file when included in the purchased service. However, final order review, field verification, installation review, engineering, shop drawings, and procurement are not included.
All measurements, field conditions, product specifications, appliance specifications, cabinet details, and installation requirements must be verified by the contractor, vendor, installer, or appropriate licensed professional before ordering or construction.
Payments and Refunds
Because services reserve time and involve custom design work, payments are generally nonrefundable once work has begun or time has been reserved.
If a cancellation or refund request is made before work begins, Kim West Design may review the request at its discretion. Any approved refund may be reduced by payment processing fees, administrative time, or work already completed.
No refunds are provided for completed services, downloaded materials, completed meetings, completed design work, or unused time after a service has started, unless Kim West Design agrees otherwise in writing.
Chargebacks and Payment Disputes
Please contact Kim West Design directly with any payment concern before initiating a chargeback or payment dispute.
Because Kim West Design provides prepaid custom design services, payments are generally nonrefundable once time has been reserved, a meeting has occurred, work has begun, files have been delivered, or custom design work has been completed.
A chargeback does not automatically cancel the amount owed for completed services, reserved time, delivered files, or custom work performed. If a chargeback or payment dispute occurs, Kim West Design may pause current work, withhold future work, cancel pending meetings, or require an alternate payment method before continuing.
If a chargeback is found to be improper or inconsistent with these Terms, the client or contractor remains responsible for the unpaid balance, processor fees, chargeback fees, administrative costs, and reasonable recovery costs to the extent allowed by law.
Nothing in these Terms limits any legally protected right to dispute a true billing error or unauthorized transaction.
Trial Offers
Trial offers are available one time only per category, unless otherwise agreed in writing. Standard pricing begins after the first trial service in each category is purchased.
Trial offers may be changed, limited, or discontinued at any time.
Intellectual Property
Website text, service menus, design materials, concepts, renderings, drawings, presentations, moodboards, files, images, and other materials created by Kim West Design are owned by Kim West Design unless otherwise agreed in writing.
After full payment, the contractor may use delivered project materials for internal project review, client discussion, pricing, and project planning for the specific project for which the materials were created.
Materials may not be copied, resold, reused for unrelated projects, altered, used as templates, publicly posted, or distributed outside the project team without written permission from Kim West Design.
Portfolio Use
Kim West Design may request permission to use selected project images, renderings, moodboards, drawings, or completed project photos for portfolio, marketing, website, or social media purposes.
Kim West Design will not knowingly publish confidential client information, private addresses, or sensitive project details without permission.
Third Party Tools and Links
This website may link to third party tools, scheduling platforms, payment processors, file downloads, cloud storage, social media platforms, or other external services.
Kim West Design is not responsible for the content, security, privacy practices, availability, or policies of third party websites or platforms.
No Guarantee of Results
Kim West Design aims to provide professional design support, visual direction, and useful project information. However, Kim West Design does not guarantee contractor sales, client approval, project profitability, construction outcomes, product availability, pricing accuracy, vendor performance, installation results, or permitting outcomes.
Limitation of Liability
To the fullest extent allowed by law, Kim West Design is not liable for indirect, incidental, consequential, special, punitive, or business losses arising from use of this website, reliance on website information, downloaded materials, design services, project delays, construction decisions, product issues, installation issues, or third party actions.
Kim West Design’s total liability for any claim related to a purchased service is limited to the amount paid to Kim West Design for that specific service.
Indemnification
You agree to hold Kim West Design harmless from claims, damages, losses, liabilities, costs, or expenses arising from inaccurate information you provide, misuse of design materials, construction decisions, installation decisions, third party errors, unauthorized use of materials, or violation of these Terms and Conditions.
Changes to These Terms
Kim West Design may update these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date.
Your continued use of this website after changes are posted means you accept the updated terms.
